Writers Guild of America Announces Independent Agreement With United Artists

LOS ANGELES, Jan. 7 /PRNewswire/ -- The Writers Guild of America and legendary United Artists Films have reached a mutually beneficial independent agreement. While the details are not being disclosed in this announcement, the comprehensive agreement addresses the issues important to writers, including New Media.

As a result of this agreement, Writers Guild members will be able to work with United Artists while the strike against other companies continues.

The agreement is unique to United Artists Films and does not involve Metro-Goldwyn-Mayer Studios Inc. (MGM), a shareholder of United Artists Entertainment.

"United Artists has lived up to its name. UA and the Writers Guild came together and negotiated seriously. The end result is that we have a deal that will put people back to work," said Patric M. Verrone, president of the Writers Guild of America, West.

Teamsters Back in Court to Stop Unsafe Mexican Trucks

Bush Administration Defies New Law by Continuing Pilot Program

WASHINGTON, Jan. 7 /PRNewswire-USNewswire/ -- The Bush administration broke yet another law in continuing to allow long-haul trucks from Mexico to use U.S. highways, according to a letter filed Monday by the Teamsters Union in the 9th Circuit Court of Appeals in San Francisco.

Congress passed an omnibus budget, signed into law Dec. 26, that includes a provision banning funds "to establish a cross-border motor carrier demonstration program to allow Mexico-domiciled motor carriers to operate beyond the commercial zones."

The Bush administration pretends the law doesn't apply to the existing program. It has said it will continue to allow some trucks from Mexico to travel beyond the narrow border zone.

"The lawlessness, recklessness and sheer arrogance of the Bush administration just blows my mind," said Teamsters General President Jim Hoffa. "Did Transportation Secretary Mary Peters somehow forget she took an oath of office to uphold the law?"

Congress clearly intended to stop the pilot program dead in its tracks according to two days of debate and 20 pages in the Congressional record.

Sen. John McCain, R-Ariz., said the provision would "prevent the pilot from going forward."

Sen. Byron Dorgan, D-N.D., the provision's sponsor, said it would "prohibit the use of funds to continue this pilot program."

Federal Motor Carrier Safety Administration chief John Hill conceded then that the Senate's overwhelming vote to ban the program was a "sad victory" for his opponents.

The Teamsters believe the pilot program creates a dangerous precedent on American highways because Mexican trucks and truck drivers are not held to the same safety standards as their U.S. counterparts.

Before today's filing, the Teamsters had already challenged the legality of the pilot program, saying it breaks several laws, including:

-- Trucks from Mexico can break federal highway safety laws requiring vehicles to be certified by the manufacturer that they meet U.S. safety standards.

-- A 2002 law forbids trucks from Mexico beyond the border until the states can enforce their violations of federal highway safety laws; five states have said they cannot do so, according to the Transportation Department inspector general report on Sept. 6, 2007.

-- A 2007 law forbids FMCSA from letting trucks from Mexico on our highways until the inspector general certifies that the agency has met all conditions set forth by Congress. The inspector general reported on Aug. 6, 2007 that FMCSA has not met those conditions.

A hearing date has been set before the 9th Circuit on Feb. 12.

The Teamsters' letter to the court submits that Section 136 of the omnibus budget, known as the 2008 Consolidated Appropriation Act, provides new authority to kill the Mexican truck program.

"If there were any doubt, however, legislative history conclusively demonstrates that Section 136 governs this case," states the letter, formally known as a "28(j) letter."

Tennessee Commercial Warehouse Layoffs Eliminate Union Supporters

Anti-union Company Targets Pro-Union Workers in Effort to Quash Organizing Effort

KINGSPORT, Tenn., Jan. 7 /PRNewswire-USNewswire/ -- In a vicious attack on human and worker rights, 33 employees were permanently laid off by Tennessee Commercial Warehouse (TCW) in retaliation to the workers exercising their legal right to join a union. The overwhelming majority of the workers had signed authorization cards with Teamsters Local 549 in Blountville, Tennessee to retain the union as their bargaining representative.

Drivers from TCW approached Local 549 in October 2007 looking for help in addressing issues they encountered in the workplace. The company was constantly making payroll errors and altering the wage structure with little or no notice to the workers. Additionally, TCW only offered expensive, insufficient health insurance that continued to rise in cost.

"TCW staged an aggressive anti-union campaign against these workers, but the drivers stood strong," said Scott Armstrong, President of Teamsters Local 549. "Nearly 80 percent of the drivers had signed authorization cards, so the company permanently laid off the entire unit rather than bargain for fair pay and benefits."

Armstrong filed for recognition for the unit on December 19, 2007 with the National Labor Relations Board (NLRB). The board scheduled a recognition hearing for January 4, 2008, but cancelled the hearing due to TCW's layoffs. The company claimed the layoffs were due to a lack in work, however TCW's actions were inconsistent with its position. Armstrong has filed unfair labor practice charges against TCW with the NLRB.

"Before we got laid off, the company had us working six days a week and was giving us job applications to pass along to other commercial drivers we knew because they couldn't keep up with the volume," said Tony Davenport, a former driver who had worked at TCW for three and a half years. "Now they have hired independent contractors and shifted work to another trucking company to make up for the layoffs."

TCW handles warehouse and distribution services for a variety of companies. The 33 former drivers ran loads from the Kingsport, Tennessee location to Columbia, South Carolina and back under a contract with Eastman Chemical Company.

"I grew up in a union household and I know what it means to have a union in your corner," said Jeff Lane, a former TCW driver. "I wanted to try to make things better at this company by bringing in the Teamsters."

Despite being subjected to captive audience meetings and intimidation by TCW management, the drivers remained determined to do their jobs to the best of their abilities. Despite only receiving pay for a 15 minute "pre-trip" period before taking the trucks on the road, the drivers would inspect each truck to make sure it was safe and rectify any issues that they could.

"We had a great bunch of drivers who were very careful about maintaining their trucks to make sure they were safe," Davenport said. "We were looking out for the company, but they weren't looking out for us."

"TCW's actions are sickening," said General President Jim Hoffa. "This is yet another example of how the deck is stacked against workers seeking union representation in this country. The laws are heavily weighted in the employers' favor, giving anti-union companies the ability to coerce, intimidate, and in extreme cases like this, eliminate anyone who wants to form a union. We must pass legislation like the Employee Free Choice Act to put the power to organize where it belongs - in the hands of the worker."

HARRISBURG, Pa., Jan. 7 /PRNewswire-USNewswire/ -- Judith L. George, the wife of Pennsylvania AFL-CIO President William George, passed away on Saturday, January 5, 2008 at her home in Mechanicsburg, Pennsylvania.

Born April 28, 1954, she was the daughter of Samuel D. and Arla J. Benedict Gracey. Judith was a former employee of the Beaver County Court House where she worked as Deputy Recorder of Deeds.

She was a member of Sewickley Presbyterian Church and also attended Mechanicsburg Presbyterian Church. Judith was a faithful wife and very dedicated mother who volunteered her time with the Mechanicsburg Band Boosters, the Mechanicsburg High School Color Guard, the DeJul School of Dance, and who acted as Treasurer of the Mechanicsburg Boy Scout Troop 80. In addition, she enjoyed crafts and making angels for Christmas as well as traveling to the beach in Sea Isle City with her family and friends.

In addition to her parents and her husband, she is survived by three daughters, Samantha G. George, Renee Martin, both of Mechanicsburg, and Shelly Scassa and her husband Dominic of Monaca, PA; son, William M. George, Jr. and his fiancee Jolene M. Cramer of Philadelphia; sister, Donna L. Gracey and special friend John E. Pedrotti of Wilkins Twp., PA; 2 grandchildren, Dominic and Sadie Martin, as well as many aunts, uncles, cousins, nieces and nephews, and friends.

Memorial service will be held at 7:30 PM Tuesday, January 8th at the Mechanicsburg Presbyterian Church, 300 E. Simpson Street, Mechanicsburg, PA with visitation held from 5:30 to 7:30 PM. Additional memorial services will be held in Western, PA at the Sharon Community Presbyterian Church, 522 Carnot Street, Moon Township with visitation at 11:30 AM and the memorial to follow on Thursday, January 10th.

In lieu of flowers, contributions may be made to the Leukemia and Lymphoma Society of Central PA, 880 Corporate Circle, Suite 100, Harrisburg, PA 17110.
