Hoffa Thanks Congress for Cross-Border Truck Ban Teamsters Pledge Continued Fight Against Dangerous Trucks from Mexico WASHINGTON, Dec. 19 /PRNewswire-USNewswire/ -- Teamsters General President Jim Hoffa today praised Congress for banning funds for the Bush administration's reckless pilot program to let trucks from Mexico travel freely on U.S. highways. The ban was part of the omnibus spending bill that Congress passed Wednesday. The Teamsters opposed the pilot project from the start because of real concerns that trucks from Mexico aren't safe. "Congress just made driving safer in the United States by ensuring that dangerous trucks from Mexico aren't lurching along our highways like unguided missiles," Hoffa said. "We expect the Bush administration to obey the law and put a stop to this dangerous program as soon as it is signed into law." Hoffa said the Teamsters have nothing against Mexican truck drivers, just the companies that exploit them. "Just ask any Teamster who drives in the Southwest," Hoffa said. "This is about safety." The Teamsters Union is suing to block the program in the 9th Circuit Court of Appeals in San Francisco. The case is expected to be heard in February. Some trucks from Mexico have been allowed to travel beyond the narrow border zone since earlier this year under the Bush administration's unsafe pilot program. Teamsters to Leaflet at United Airlines Terminals During Busy Travel Day Campaign Warns That UAL Outsources Maintenance to China Teamsters, airline mechanics and a costumed Santa Claus will leaflet each of eight major airports on Thursday, Dec. 20, one of the year's busiest travel days. They will tell air travelers that United Airlines outsources all heavy maintenance of its Boeing 747s and 777s to South Korea and China. In the Beijing repair facility, only five of 2,179 mechanics are certified by the Federal Aviation Administration. United now wants to sell its San Francisco maintenance facility. The leaflets ask travelers to tell United to use certified mechanics. Teamsters Laud Attorney General for Citing FedEx Ground for Misclassifying Workers FedEx Violated Massachusetts' Independent Contractor Law WASHINGTON, Dec. 19 /PRNewswire-USNewswire/ -- Massachusetts Attorney General Martha Coakley has cited FedEx Corporation (NYSE:FDX) subsidiary FedEx Ground for intentionally misclassifying 13 pickup and delivery drivers as independent contractors rather than employees. Coakley also fined FedEx Ground $190,000 in penalties and ordered the company to fix the employment status and pay the 13 drivers restitution. There are more than 400 drivers for FedEx Ground in Massachusetts, and the AG's office released a press statement today saying the investigation is ongoing. FedEx has 10 days to appeal the citations to a state administrative law agency. The AG's office began investigating FedEx this summer after receiving a driver's complaint over his employment classification. "I applaud the just actions taken by Massachusetts Attorney General Martha Coakley in targeting the scofflaw FedEx Ground," said Teamsters General President Jim Hoffa. "FedEx Ground has for too long passed unnoticed as it calls its drivers 'independent' but illegally controls them like employees. But FedEx Ground is running out of places to hide. This action in Massachusetts is another nail in the coffin of FedEx's illegal business model." FedEx Ground and its subsidiary FedEx Home Delivery have lost a series of court decisions, labor board determinations and state agency rulings which found the two companies to be misclassifying its drivers as contractors. Most recently, the California Supreme Court refused to review a California Court of Appeal ruling that found single route drivers in that state to be misclassified. The California Supreme Court action ended seven years of litigation and let stand the civil judgment that drivers were company employees. "FedEx has broken the law here in Massachusetts and the company finally got caught," said Teamster Local Union 25 President Sean O'Brien. "FedEx Ground drivers in Massachusetts are standing up to this company and winning. We are proud to welcome the drivers in the Wilmington, Mass., terminal as brothers and sisters in Local 25." Maximum Weekly Benefits to Increase for Injured, Out-of-Work Pennsylvanians in 2008 Unemployment Taxes on Businesses, Workers to Decrease $190 Million HARRISBURG, Pa., Dec. 19 /PRNewswire-USNewswire/ -- Some Pennsylvanians who are out of work through no fault of their own, or due to workplace injury, will receive higher compensation beginning Jan. 1 when maximum weekly benefit amounts increase for those filing a new unemployment or workers' compensation claim. Unemployment compensation taxes on employers and workers, which are the primary source of unemployment benefits, will decrease by $141 million and $49 million, respectively, in 2008. "Pennsylvania's economy is growing," Governor Rendell said. "But even with a record-high job count, low unemployment and increased wages, many do not share fully in that prosperity. Increasing the maximum weekly benefits helps ease the financial strain on those who are unemployed, or injured and unable to work." Due to a statewide increase in average weekly wages, the maximum weekly unemployment benefit will increase to $539 - $19 over the 2007 maximum, and the maximum weekly workers' compensation benefit for those injured on the job will increase to $807 - $28 over the 2007 maximum. Pennsylvania employers' average unemployment tax rate for 2008 is projected to be 4.7 percent, down from 5 percent in 2007. Taxes on employee wages will drop to .06 percent (60 cents per $1,000) in 2008, down from .09 percent in 2007. "This will be the second consecutive year of unemployment tax savings for both employers and workers," Governor Rendell noted. "These are tangible results of strategic investments we have made in workers, businesses and communities to create a stronger economy." Unemployment compensation payments for workers who lose jobs through no fault of their own are, generally, one-half of a worker's former salary, up to a weekly maximum determined each year. As stipulated by law, the weekly unemployment compensation maximum is calculated using the yearly average weekly wage. In addition, the average weekly wage is used to set the weekly workers' compensation maximum. Workers' compensation benefits for people injured on the job are, generally, two-thirds of a worker's wages at the time of injury, up to the weekly maximum set each year. PIA Praises Seven-Year TRIA Extension House Bill Provides Certainty, but Some Program Expansion Still Needed WASHINGTON, Dec. 19 /PRNewswire-USNewswire/ -- Approval of legislation by the U.S. House of Representatives to extend the Terrorism Risk Insurance Act (TRIA) for seven years will provide stability for insurance clients, according to the National Association of Professional Insurance Agents (PIA). The House passed a bill by a 360-53 vote on December 18 that extends TRIA, which was scheduled to expire on December 31. In doing so, the House abandoned two previous attempts to greatly expand the scope of the program. The bill passed by the House mirrors one already adopted by the Senate, and adds coverage for acts of terrorism by domestic terrorists. President Bush had threatened to veto the previous House versions while saying he'd sign the Senate's version. Gov. Rendell Proclaims First Coal Miners' Day; Comments on Proposed Mine Safety Legislation HARRISBURG, Pa., Dec. 19 /PRNewswire-USNewswire/ -- Governor Edward G. Rendell recognized the contributions and sacrifices the state's coal miners have made to Pennsylvania during a ceremony today officially marking Dec. 19, 2007, as Coal Miner's Day. The Governor used the opportunity to announce an agreement between the administration, the legislature, labor unions and mining companies on key issues that will be incorporated into legislation intended to strengthen Pennsylvania's 130-year-old deep mine safety law. "It's important that we keep in context just what our coal miners do," said Governor Rendell, noting the more than 51,000 mining fatalities that have occurred in Pennsylvania since 1870. "The number of mining deaths emphasizes the importance of coal mining safety. "When the legislature gets back in January, new legislation strengthening Pennsylvania's mine safety law, which has not been updated since 1961, will be introduced. It is my hope that this legislation will be enacted swiftly. It is good and groundbreaking legislation because it establishes so many important things and puts the responsibility for mine safety where it belongs." Among other things, the Governor said, the bill would make the mine owner or operator primarily responsible for safety at the mine, and would create a seven-member Mine Safety Board with the authority to write regulations, making it easier to implement 21st century safety technologies rather than be hampered by 19th century legislation. The proposed bill would also enact more stringent requirements for verifying underground mine maps and for establishing barriers between new mines and abandoned mines. This provision would put into law a rule Governor Rendell instituted in the wake of the 2002 Quecreek accident. "It's important for our miners and their families to know that even while this legislation has been debated, the administration has taken some important steps to ensure the safety of our miners," said Governor Rendell. The Governor highlighted the following improvements made to Pennsylvania's mining operations since 2003: -- Requiring safety officials to review every mine permit application and say "No" if they think unsafe conditions may exist. -- Implementing stringent new requirements to validate and verify underground mine maps before new mining can take place. -- Increasing the distance between planned mining and abandoned mines from 200 to 500 feet to provide an extra measure of security so miners don't accidentally breech an abandoned mine pool, as happened at Quecreek. -- Replacing outdated equipment that was more than 30 years old with 48 new, self-contained breathing units at a cost of $415,000 for use by underground mine rescue teams. The units are housed at three mine rescue stations Cambria, Fayette and Schuylkill counties. -- Developing and implementing training for managing mine inundation, as well as continuing education programs for mining professionals, mine managers and mine inspectors. Today's commemoration marked the 100th anniversary of Pennsylvania's deadliest mine accident. A dust and gas explosion in the Darr Mine in Westmoreland County on Dec. 19, 1907, killed 239 miners. December 1907 is the deadliest month in United States mining history; 3,242 miners were killed in accidents that month, including 1,514 in Pennsylvania. Hotel Workers Union Contacts Consumers, 'Don't Deposit at Countrywide' SAN FRANCISCO, Dec. 19 /PRNewswire-USNewswire/ -- "Don't feed the bank that bites you" says a sign held by a UNITE HERE union member at Wednesday's action in San Francisco. Expanding their "Don't Deposit at Countrywide" campaign this week, the labor union UNITE HERE approached consumers outside Countrywide Bank centers across the country. The union is asking consumers not to deposit their savings at Countrywide. These borrowers will not be helped under the recent deal by the Treasury and the mortgage industry which only covers adjustable rate loans that reset between January 2008 and July 2010. At Countrywide, as of Sept. 30th 2007, sub-prime mortgages valued at almost $6 billion were already pending foreclosure. The crisis has incited borrower protests, media scrutiny and government attention. Representing 450,000 members in North America, UNITE HERE is one of the latest groups focusing on Countrywide. Across the street from Countrywide's financial center in San Francisco, costumed demonstrators drew attention on busy Van Ness Ave. A man wearing a bloated pig mask complete with smoking cigar represented the Countrywide Piggy-bank; others were dressed as the Foreclosure Vulture and the Predatory Loan Shark. Union members handed out leaflets to intrigued passer-bys. The message: "Don't Feed the Animals." UNITE HERE research analyst Harlan Kung believes the campaign has appeal: "Many people agree we need to pressure Countrywide to do more to help borrowers because they think Countrywide's efforts have been too little, too late." The "Don't Deposit at Countrywide" campaign counters Countrywide's aggressive efforts to attract deposits from individuals. Because of its perceived risk, Countrywide has had trouble financing loans through the credit markets and is looking to consumer savings to increase its cash flow. Bush Administration Sides With Trucking Industry, Ignores Drivers Teamsters Say Regulators Used Flawed Analysis in Their Zeal to Satisfy Trucking Industry WASHINGTON, Dec. 19 /PRNewswire-USNewswire/ -- The Bush administration's reinstated hours-of-service rule meets the economic needs of the trucking industry but not the health and safety needs of truck drivers, a Teamster official told the Senate surface transportation subcommittee on Wednesday. The Federal Motor Carrier Safety Administration (FMCSA) issued an interim final rule last week. The rule, which was twice thrown out by the court, allows truck drivers to work as many as 84 hours a week. "The FMCSA is more concerned about the economic viability of the trucking industry than about the safety and health of the drivers in this rulemaking," said LaMont Byrd, Teamsters director of safety and health. The rule is almost identical to the industry's 2003 proposal, Byrd said. Byrd said the FMCSA cherry-picked from studies supporting its position that an 11-hour driving limit did not result in more fatal crashes than the previous limit of 10 hours. The Teamsters reviewed the information provided by FMCSA and found that it does not support the agency's claim. Byrd said FMCSA acknowledged in the past that the risk of a crash doubles from the 8th hour to the 9th hour of driving, and doubles again from the 10th to the 11th hour. "The Bush administration doesn't care if unsafe Mexican trucks or exhausted truck drivers endanger everyone traveling on our highways," said Teamsters General President Jim Hoffa. "The Bush administration could have objectively reviewed the scientific literature," Hoffa said. "It could have conducted studies to answer any open questions. It could have talked to truck drivers and safety advocates and other highway users. But it did none of those things. "All the Bush administration did was ask the trucking industry for marching orders," Hoffa said. Background The Federal Motor Carrier Safety Administration (FMCSA) first promulgated the hours-of-service rule increasing the number of hours truckers can drive in 2003. The Court of Appeals for the D.C. Circuit struck down the rule in 2004, but Congress reinstated it as part of the Surface Transportation Extension Act of 2004. FMCSA issued a new Notice of Proposed Rulemaking in January 2005, proposing a rule that was little changed from the 2003 rule that had been struck down. On July 24, the U.S. District Court of Appeals for the D.C. Circuit for the second time threw out the rule that increased driving time to 11 hours from 10 hours and allowed drivers to go back to work after being off duty for only 34 hours. In the 39-page opinion, Judge Merrick Garland called the rule "arbitrary and capricious." The International Brotherhood of Teamsters was a party in the case, joining Public Citizen and the Owner-Operator Independent Driver's Association The deadline for the court's July decision to go into effect was Sept. 14. But legal challenges pushed that deadline back. FMCSA issued the interim final rule on Dec. 11.
